The Netherlands Supreme Court deals with cassation cases. Unlike in matters that are dealt with before the District Courts and the Courts of Appeal, the Netherlands Supreme Court does not decide on the facts, but merely renders a decision on the proper applocation of the law. Decisions can also be quashed in cases where a decision of a lower court is incomprehensibly motivated.
A party that contemplates to bring a case before the Netherlands Supreme Court requires the assistance of a specialized admitted cassation lawyer. It is advisable to immediately contact a cassation lawyer for advice, as the greevances against the decision need to be discussed and formulated before the end of the appeal term, as the grounds for the appeal in cassation need to be filed within the term.
